hrm, my friend was thinking that since i go back to the docs on tuesday, i should send them an email just letting them know this and to recap the meeting on last tuesday....they told me everyone else is allowed comp time back but im not because im on performance review, ask that i do not work my part time job, and got angry about this etc.

he said i should let them know i am starting to document everything and even if they dont respond to the email its documented i sent it.

what do you think?

If you're looking to get fired, that's the perfect way. Start saying you're documenting things and they'll do the same. FMLA allows you to use any and all of your comp time, no one is "ineligible" to use it. If you really want to get them in hot water, say that you're going to take it to the state department of labor. That'll get them in a huff, because every company when a state audit is done is probably doing something wrong. (I'm certain your company is doing something wrong, and it's up to you. All states have a no retaliation clause for whistleblowers, so, you'd be covered if you called the state)

when i go back, should i expect to be fired that day? N.J is an At Will State.

At-will doesn't mean that they can just fire you. They must show due cause, or you have a case against them for unfair termination.

oh great, i go back tomorrow. dr kept asking if i was ready, and im not at all but i said i am. i was thinking of doing a long term thingy while i look for a new job, but i never mentioned that. he wants me to go see a pys, maybe. i have vegas coming up in 2 months, thats all i have to go is 2 months then another week off lol.

i figured i can study for my certs at night when no one is around. this is until they change my hrs, i know that is in the works.

i need to go back in at the top of my game. they are going to be like wolfs and i know i need to be ready >:P

So, work denied my 3 days vacation I put in about 3 weeks ago for Vegas sept 1-3. They claim sept 1 is a busy day. To be honest it is as they explained it, but I was unaware everything was happening. The thing is they can really make do, that's why we have contractors and they can pull from help desk which is what they do in the past. This is what they tell us, we need to fill in and help other areas as needed.

I know for sure h.r was involved in this. they also sent a email to everyone no vacations this week. The thing is, I talked to my bosses and there is leeway here to get them approve(I know it!!) it as I picked up that vibe, they know they can fill me if they wanted too. I just dont know how to i guess.


I already booked with and paid with 5 other people, i really wanna go. The handbook says any call outs 3 or more in a row needs a note, or can be considered termination. So if I call out, im fired. If i get a dr's note, im fired anyway as they will find something.

any suggestions? Should I try my bosses again? I dont want to piss them off and give them any ammo. They dont know I paid already. I dont want this decision to really mess me up. I know the job market is bad out there. I can find a job, i know that. But I might not find another job in my field for a while. Alot of my peers have looked, and they cant find anything.

If you say you bought the tix, they'll tell you that until it's approved, you shouldn't do that. If you call out again, you'll prob be terminated. You can ask again, but I have a feeling they'll say no. They're trying to make you fuck up so you'll get fired.

I kinda think/know that and there just using this busy week as an excuse to say they need me when they dont. My friends convinced me to try again so I emailed my direct boss and he said he will sit in with me with the big boss tomorrow.

I plan on saying that they should reconsider because my time is well knowed to be from 1-10pm and I would not benefit this day as by 1pm everyone will be back in the office. That our customer base respects me and values me and this should be considered for this decision as in the past I have always changed days off if needed and that I am just asking this one time to be reconsidered.

Do you have anything else to suggest I throw in?

If the above doesnt work should I use some of the ammo below?


1)One time at 3am in the morning during our server move my boss realized the right 240volt plug wasnt used and we were screwed, because come 6am is when hell was going to freeze over and it might of even caused my boss his job. So I made a phone call to my part time job, got the ok from the manager(as they were closed) to come in and get what I needed(drove an hr one way). He could of got fired for that if they wanted to be dicks. But anyway my boss did the electric work and we were able to boot the servers.

2)I have done some reading on labor laws, and I am ready to light the fire. By what I know, we can not be considered exempt and overtime laws follow us, and there are penalties for this. We are entitled to DOUBLE what we are owed in overtime(if we can prove). Im sure there might be fines for this too. This along along with there bully tactics and unfair treatment( i had a conversation the other day with someone, he said he is always late because he doesnt take lunch!!!!!)might be enough for a lawyer to want to get involved. I dont want to really call the depart of labor, if they help me out ill be nice to them.
